GENERAL FUNCTIONUnder the administrative direction of the Commissioners, the Administrative Law Judges (ALJ) are assigned responsibilities required by Oklahoma state statutes and agency administrative rules, including reviewing records, conducting hearings, determining pertinent issues, and rendering decisions to be adjudicated by the Oklahoma Tax Commission. Responsibilities vary and may range from routine in nature to highly complex, based on the level of the ALJ.TYPICAL FUNCTIONSThe functions performed by employees in this job family will vary by level, but may include the following:General

  • Conducts required pre-hearing conferences and status conferences, as needed, with case parties
  • Issues decisions in the form of Findings, Conclusions, and Recommendations (FC&Rs) following hearings, or the submission of cases for decision on briefs, based on the review of stipulations, briefs, testimony, documentary evidence, arguments, and applicable law
  • Issues orders on motions, including but not limited to, motions to dismiss for lack of jurisdiction, motions for summary disposition, motions on evidentiary matters, and motions for scheduling orders
  • Oversees the scheduling of pre-hearing conferences, status conferences, and hearings in cases, including the noticing of such matters
  • Reviews various reports relating to case status filed by case parties and drafts non-standard correspondence responsive to those reports
  • Researches applicable law including statutes, rules, regulations, and case law relating to legal issues presented in pending cases
  • Performs other related work as required and assigned

Level II

  • May supervise Legal Secretary or other positions as required, including approval of leave and performance management
  • Presides over hearings on protests and claims for refund, including maintaining order in the proceedings, administering oaths to witnesses, questioning witnesses, considering testimonial evidence, documentary evidence and arguments, ruling on the admissibility of offered evidence, and closing the record

MINIMUM QUALIFICATIONSLevel II
Education and Experience requirements at this level consist of

  • J.D. from an accredited law school; PLUS licensed to practice law in the State of Oklahoma; PLUS seven years of experience practicing law in the areas of state government, tax litigation, administrative law, or other related area
  • Preference may be given for prior ALJ experience

SPECIAL REQUIREMENTSThis position may require occasional travel. Applicants must have reliable transportation and be willing and able to perform all job-related travel. Possession and maintenance of a valid Oklahoma State Driver’s License is also required.Core work hours for the Oklahoma Tax Commission are Monday through Friday, 7:30am to 4:30pm. This schedule may require minor flexibility based on the needs of the agency.Telework may be required based on the needs of the agency, division, and section. If applicable, applicant must be willing and able to BOTH work on-site and telework at an off-site location, generally in the applicant’s home.
